Mombasa Litigant sues CS Murkomen, IG Kanja Over Withdrawal of Natembeya and Khalwale Security

The Centre for Litigation Trust (CLT) sued Interior Cabinet Secretary Kipchumba Murkomen and Inspector General of Police Julius Kanja on Friday over the recent withdrawal of security for Trans-Nzoia Governor George Natembeya and Kakamega Senator Boni Khalwale.

Mombasa Litigant and CLT Executive Director Julius Ogogoh termed the withdrawal of the security detail of the two legislators as illegal, unconstitutional, and an attempt to intimidate the political leaders to change their political stand.

In the Petition before Justice Lawrence Mugambi, Ogogoh also termed Murkomen's decision as discriminatory in nature since all other Governors and Senators continue enjoying security provided by the National Police Service.

"The decision by the 1st Respondent {CS Murkomen} to withdraw the security of the 1st and 2nd Interested Parties {Natembeya and Khalwale}  is a total disregard of the Constitution and the Law regarding the protection and security of VIPs, in particular Governors and Senators' says CLT.

CLT added that the decision by CS Murkomen threatens and exposes Natembeya and Khalwale to security risks of being attacked and harmed based on the nature of their duties.

"The decision by the 1st Respondent CS Murkomen threatens and exposes the 1st and 2nd Interested Parties to security risks since they are at risk of being attacked and harmed based on the nature of their duties as Governor of  Trans- Nzoia County and Senator of Kakamega County, respectively" says CLT through an affidavit sworn by  Ogogoh.

Article 10 of the Constitution sets out national values and principles of governance that bind all state officers , state organs, public officers and all persons and required to apply the national values and principles of governance, including inter alia the rule of law , participation of the people, social justice, equity, non-discrimination, protection of the marginalized, good governance, integrity, transparency, accountability and sustainable development.

CLT said CS Murkomen and IG Kanja are bound to apply the aforesaid values and principles.

Represented by Lawyer Nicholas Kamwenda of N.M. Kamwenda & Company Advocates, the CLT Chef Officer said the right to fair administrative action is a reflection of some of the national values in Article 10, such as the rule of law, human dignity, social justice, good governance, transparency and accountability.

"Consequently, where an action taken by the administration affects or threatens individuals, the procedures followed comply with the constitutional standards of administrative justice, which does not obtain in the instance case" He says in the petition filled under Certificate of Urgency.

The decision to withdraw the two legislators' security details consequently disregarded the constitution and the law regarding the protection of and security of the judges of the High Court of Kenya

"Furthermore, the 1st and 2nd Respondents (CS and IG) have disregarded the Rules of natural justice by condemning the 1st and 2nd Interested Parties (Natembeya and Khalwale respectively) unheated. Up to date the 1st and 2nd Interested Parties are yet to be informed of the reasons that led to the abrupt withdrawal of their security detail," added Ogogoh.

The Centre for Litigation Trust therefore asked  Justice Mugambi for an order of certiorari quashing any decision by Murkomen and Kanji withdrawing the security of Governor Natembeya and Senator Khalwale.

CLT  further asked the court for an order of mandamus to compel Murkomen and Kanja to forthwith restore the security of the two legislators.
